Sir:
In reply to tho concluding sentence- of your communication
datod October 4, 1899, you are advised that tho Indian Appropriation
Act approvod March 1, 1899, contains tho following paragraph:
"That the Secretary of the Interior be, and ho la horeby
author.zed, in hi3 discretion, to grant rights of way for tho construction
and raaintonanco of dams., ditchos, and canals, on or
through the Uintah Indian Rosorvation in Utah, for tho purpose of
diverting and appropriating tho waters of the streams In eaid
reservation for useful purposes: Provided, That all such grants
shall bo subject at all times to tho paramount rights of tho Indiana
on said reservation to so nueh of aaid -waters as nay have
been appropriated, or may hereafter be appropriated or needed by
then for agrlculturnl and domestic purposes; and it shall be the
duty of the Secretary of tho Interior to prescribe suoh ruloa and
regulations as he may deem nocesaary to secure to tho Indians tho
quantity of wator nocdod for thoir proscnt ur.d prospective wants,
and to otherwise protect the rights and interests o.f the Indiana
and the Indian service."
Thl3 office is not advised that any authority has been granted
by the Secrotary undor said provision.
Your request to have the party from the Ooologiccl Survey
notified to make an investigation of certain ditches en the western
line of the reservation, has been subnittod to the Dopar'traent
for such action as tho Secretary may deem proper.
