by the Acting Commissioner that "notwithstanding the positive
statements of 3everal officials I am convinced that the Uintah
Valley Indians were not parties to the treaty of 1363 or to
the Brunot agreement."
In regard to the averment in Paragraph VI of the petition
that the petitioners know of no just set-off chargeable
to them "except the capitalized annuity and tha annual interest
thereon hereinbefore set off", in Paragraph IV of the petition,
it will be noted that under Section 3 of the act of
1830 the United States is to be reimbursed out of the proceeds
of the sale of Ute lands "for all sums paid out or set apart
under this act by the Government for the benefit of said In—
dians." The amounts so reimbursable are believed to be about
as f0II0W3,up to and including June 30,1903:
Amount set apart as a perpetual trust fund
under Section 5 of said act, $1,250,000.00
$4,000.00 per annum for 10 years to . , A.'.. A '•-
certain Indians, per Section 6, 40,000.00
Payment of expenses of commissioners
per Section 9, 25,000.00
